1. SCOPE OF THIS PRIVACY POLICY
TEA Solutions, Inc. (“TEA Solutions”) is a U.S.-based non-profit public power-owned corporation that provides U.S. based entities with energy marketing and risk management services to maximize their assets. Similarly, The Energy Authority, Inc. (“TEA”, and together with TEA Solutions, “us”, “we” or “our”) is a U.S.-based non-profit public power-owned corporation that provides U.S. based public power utilities with access to resources and technology systems to enable our clients to respond competitively to changing energy markets. We are committed to protecting the privacy of the individuals about whom we collect Personal Information. Both TEA and TEA Solutions only conduct business in the United States. This privacy policy (“Privacy Policy”) addresses how we use, share, safeguard, retain and delete the Personal Information (defined below) that we collect through our respective corporate websites (the “Website(s)”).
2. PERSONAL INFORMATION
For purposes of this Privacy Policy, the term “Personal Information” means any information relating to an identified or identifiable natural person. The Personal Information that TEA and TEA Solutions collect through their Websites pertains to persons operating in their capacity as an owner or employee of a company or other type of legal entity. Given this fact and the fact that both entities are non-profits, we are not subject to the U.S. state laws governing the privacy of personal data (“Privacy Laws”).
3. PERSONAL INFORMATION THAT WE COLLECT
As explained above, TEA and TEA Solutions are not subject to Privacy Laws. However, we may collect information about visitors to our Websites.
Information provided manually: When an individual visits our Websites, they may (but are not required to) utilize our “Contact Us” and “Learn More” links to initiate an email to us. Individuals can also submit information (e.g., name, email address and mobile telephone number) through our “Career” portal, which is managed by ADP, Inc. The entities with which we do business (“Clients”) have access to a TEA@Work portal (the, “Portal”). We collect name, work address, work email address, and work telephone number) from Clients utilizing that Portal.
Information collected automatically via technology: When you visit our Websites, including when using the Portal, our goal is to make the experience simple and effective. To that end, we use text files, known as cookies, to track information about your use of our Websites/Portal. A cookie is a text file that a website stores on a visitor’s computer to enable recognition of that visitor’s computer each time they return. As you navigate through and interact with our Websites/Portal, we will automatically collect certain information about your equipment, browsing actions and patterns using these cookies. This may include information such as: (i) your IP address and browser information; (ii) the pages you access on our Websites/Portal and the date and time of such access; and (iii) time you spend on our Websites/Portal. TEA and TEA Solutions enable Website visitors to affirmatively indicate their wishes with respect to the placement of cookies on their devices through our “cookie banner. ”You may “Accept All,” “Reject All,” or utilize the “Preferences” button to customize your cookie permissions. You can withdraw your consent to the placement of cookies at any time by toggling your preferences.
4. OUR USE OF THE INFORMATION THAT WE COLLECT
Information We Collect Through the Portal:
We use the information collected from Clients in order to authenticate Clients, to provide services to such Clients, to manage their accounts, and sometimes to communicate with Clients.
Information We Collect Through the Websites:
Information that you provide manually: TEA and TEA Solutions use the information that Website visitors provide through our Websites in order to respond to their inquiries and requests, including processing applications for employment. We do not use the information for any other purposes. We do not sell, share, or otherwise disclose this information to anyone other than our own vendors in the context of their performing services for us.
Information collected automatically via technology: The information we collect via cookies helps us to improve our Websites/Portal and deliver better and more personalized content and services. It also enables us to estimate our audience size and usage patterns and to recognize when a specific device returns to our Websites/Portal.
- Our Websites use Google Analytics. Google Analytics places cookies on a visitor’s computer that generate specific information about the visitor including the URL of the page they visit and their IP address. Google may also set cookies on a visitor’s browser or read cookies that are already there. That information is transmitted to and stored by Google. Google uses the information shared to deliver its services, maintain and improve them, develop new services, measure the effectiveness of advertising, protect against fraud and abuse, and personalize content and ads you see on Google and on its partners’ sites and apps. TEA and TEA Solutions use the information collected through cookies to evaluate use of our Websites/Portal, improve the functionality and useability of our Websites/Portal, and for similar operational purposes.

Other cookies are “persistent cookies,” which means that they can stay on a visitor’s device for an extended period of time. You can manage cookies through your web browser. 5. OUR DISCLOSURE OF THE INFORMATION THAT WE COLLECT
There are circumstances in which we may disclose Personal Information to trusted entities in order to improve, protect, and support our business. For instance, we may disclose Personal Information: (i) to service providers (e.g., hosting providers, business advisors, auditors, etc.), or; (ii) if required to do so by law or in the good faith belief that such action is necessary to: (a) comply with a legal obligation; (b) protect and defend our rights or property; or (c) protect the rights, property, or safety of the entities with whom we do business, visitors to our Websites, or the public. We require the host of the Portal to process Personal Information strictly for our Clients’ use of the Portal and in accordance with the contract with such service provider. We bind those service providers to whom we disclose Personal Information to contractual privacy and security obligations consistent with this Privacy Notice and applicable laws.
6. CHILDREN’S PRIVACY
The Portal and the Websites are not marketed to, nor intended for use by, children. Therefore, we do not knowingly collect any Personal Information from children under the age of 17. If you know or believe that such information has been provided to us, please contact us at 904-356-3900. If we become aware that we have collected Personal Information about a child under the age of 17, we will delete it.
7. HOW WE PROTECT INFORMATION
We take reasonable administrative, technical, and physical measures designed to safeguard against unauthorized access to, loss alteration, disclosure, or misuse of the information we collect. We update and assess our security controls on a regular basis. We also make our personnel aware of the importance of confidentiality, security, and privacy, and limit our personnels’ access to Personal Information to only those employees who require access based on their job duties. Electronic information, including the information about visitors to our Websites and information submitted by our Clients through the Portal regarding their account and log-in information, is stored on systems of an enterprise third party cloud provider.
Unfortunately, no transmission over the Internet or method of electronic storage can be guaranteed to be 100% secure. As a result, while we strive to protect your information, we cannot ensure or warrant the security of such information, and any such information provided by you or through your use of the Websites or Portal is at your own risk. Once we receive your transmission, we make reasonable efforts to ensure security on our systems.
8. CHANGES TO THIS PRIVACY POLICY
Over time, we may update this Privacy Policy to align with changes in the Websites/Portal, our business, and/or Privacy Laws. The “Last Date Modified” at the beginning of this Privacy Policy reflects the last date on which the Privacy Policy was updated. We recommend that you periodically review the Privacy Policy to stay informed of changes. We will ask for your consent to such changes if required by Privacy Law. In other cases, please note that your continued use of the Portal and your continued use of the Websites after any change means that you agree to the terms of the updated Privacy Policy. If you disagree with the Privacy Policy, please stop using the Portal and Websites.
9. HOW LONG DO WE RETAIN PERSONAL INFORMATION?
Information about Portal Clients: We retain Personal Information collected from Portal Clients for as long as necessary to fulfill the purpose(s) for which it was collected, including legal, accounting, and reporting requirements or as otherwise set forth under applicable law.
Information about Website Visitors: TEA and TEA Solutions retain Personal Information about those who visit their respective Websites for as long as necessary to fulfill the purpose(s) for which it was collected, including legal, accounting, and reporting requirements or as otherwise set forth under applicable law.
